# What is the Take It Down Act? Texas bills seeks to ban deepfake online revenge porn.

WFAA reports that in October 2023, a student used her Instagram pictures and artificial intelligence to create fake nude photos of a 14-year-old girl. She claimed that nine other students were also victimized.

Fake photos also spread to other social media platforms. Berry and her mom approached Washington lawmakers for help after trying unsuccessfully to get Snapchat to remove the images.

In less than 24 hours, the accounts were deleted.

## What is the Take It Down Act in Texas

In the first week of this month, [U.S. Senator Ted Cruz has introduced the Take It Down Act](https://removemymugshot.org/deepfake-removals/), which aims to address exploitation by immobilizing technological deepfakes. The bill is designed to empower and protect victims of non-consensual sexual abuse, also called “revenge pornography.”

## What is a Deepfake?

A deepfake can be an image, video, or series of pictures generated using machine learning, known as “deep” learning.

The university explained that deep learning is similar to machine learning. An algorithm is given examples and is taught to produce outputs similar to the examples from which it learned. Humans also learn in the same manner. A baby may try to eat random objects and quickly discover what’s edible.

## What other provisions are included in the “Take It Down” Act?

The bill also aims to address the following:

- The bill prohibits the publication or threat to publish non-consensual images on social media platforms and other online platforms.

- The bill allows the disclosure of intimate images in good faith, for example, to medical treatment or law enforcement.

- Social media sites and other websites will be required to implement procedures for removing “revenge-porn” within 48 hours of a valid victim’s request. Websites are also required to make reasonable efforts in order to remove the images.
